How long do I have to bring suit?

Generally speaking, the statute of limitations for medical malpractice in Virginia is two years from the date of the malpractice or from the last date you treated with the same doctor for the same or a related illness. For minors, generally speaking, the statute of limitations is two years or until the child’s tenth birthday, whichever is longer.
