  • Joint legal custody — Even if a child spends most of their time living with only one parent, when parents have joint legal custody they share the power to make decisions about the child’s education, religion, health care and other aspects of daily life.

Unless a parent is unfit or unwilling to provide care, they will likely maintain visitation rights even when the other parent has sole custody. Visitation refers to a parent’s right to spend time with their child.
