Uninsured Motorists Accidents

Experienced Virginia Lawyers Assist Victims of Uninsured Motorists

Charlottesville firm seeks damages from drivers who lack sufficient coverage

From offices in Charlottesville and three other locations, the dedicated attorneys of Tucker Griffin Barnes P.C. help Virginians to recover damages stemming from auto accidents caused by uninsured and underinsured drivers. Unlike other states, Virginia does not require all drivers to carry car insurance. The Insurance Research Council reports that about one in ten Virginia drivers are uninsured. If you are involved in an accident with an uninsured or underinsured driver, you may encounter difficulty getting the at-fault party to pay for the costs of the accident. Our firm takes action to hold negligent drivers accountable.

Attorneys represent plaintiffs in lawsuits against at-fault vehicle operators

A Virginia motor vehicle owner may opt out of registering a vehicle for car insurance by paying the Uninsured Motor Vehicle fee to the DMV and risking the consequences. Driving uninsured is a high-stakes gamble, so most drivers choose to maintain vehicle coverage. Under Virginia law, an insured vehicle must have a liability insurance policy that covers at least:

  • $25,000 for the bodily injury or death of one person
  • $50,000 for the bodily injury or death or two or more people
  • $20,000 in property damage

Liability insurance is used to pay for losses sustained by an auto accident victim. However, the total expenses of an accident can easily exceed the minimum liability coverage limits. This often occurs in cases where more than one person is injured in an accident. An at-fault driver is considered to be underinsured if his or her policy cannot cover the full costs of the accident.

All vehicle insurance policies in Virginia must include underinsured (UIM) motorist coverage. This coverage kicks in if the negligent driver lacks coverage or if their insurance policy is exhausted and the injured party still has bills to pay. As an injured motorist or passenger, your own UIM insurance may be used to help cover your remaining expenses.

Our personal injury attorneys represent clients hurt in car accidents throughout Virginia, from Albemarle County and the surrounding areas and down the Blue Ridge Parkway in the southwestern part of the state. We can assess your case and prepare a thorough strategy for recovering compensation.

Determined litigators hold negligent drivers accountable for accident costs

After you are hurt in an accident, you can file an insurance claim with the at-fault driver’s carrier and/or with your own insurance carrier. It may also be necessary to file a lawsuit to hold a negligent driver or organization liable. Damages that may be recovered after a motor vehicle accident include:

  • Medical expenses for hospital bills, surgery, rehabilitation, physical therapy, and other costs
  • Vehicle repair or replacement
  • Lost income from time off of work
  • Pain and suffering

Virginia is an at-fault state, meaning that the person or entity who is at fault for an accident is financially responsible for losses incurred by victims. It is also a contributory negligence jurisdiction, so a plaintiff driver who is partly at fault for a crash cannot recover damages.

Proving that someone else was at fault for your accident is the first step toward obtaining the compensation needed to pay for your accident expenses. Our accomplished attorneys build strong cases demonstrating the fault of negligent drivers and organizations. We passionately represent our clients and assert their rights to receive reimbursement for all eligible costs.
