A Virginia motor vehicle owner may opt out of registering a vehicle for car insurance by paying the Uninsured Motor Vehicle fee to the DMV and risking the consequences. Driving uninsured is a high-stakes gamble, so most drivers choose to maintain vehicle coverage. Under Virginia law, an insured vehicle must have a liability insurance policy that covers at least:

  • $25,000 for the bodily injury or death of one person
  • $50,000 for the bodily injury or death or two or more people
  • $20,000 in property damage

This often occurs in cases where more than one person is injured in an accident. An at-fault driver is considered to be underinsured if his or her policy cannot cover the full costs of the accident. 

All vehicle insurance policies in Virginia must include underinsured (UIM) motorist coverage. This coverage kicks in if the negligent driver lacks coverage or if their insurance policy is exhausted and the injured party still has bills to pay. As an injured motorist or passenger, your own UIM insurance may be used to help cover your remaining expenses.
