Frequently asked questions about medical malpractice

Can I sue for medical malpractice?

A patient injured due to medical negligence can file suit.  When the injured patient is a minor, hir or her parents may sue on his/her behalf.  When someone dies as a result of medical negligence, the administrator of the deceased person's estate may sue for wrongful death.

How long do I have to bring suit?

Generally speaking, the statute of limitations for medical malpractice in Virginia is two years from the date of the malpractice or from the last date you treated with the same doctor for the same or a related illness.  An exception exists for foreign objects found in your body.  Pinpointing the statue of limitations date in a medical malpractice case is very technical.  You should always consult an attorney regarding the facts of your case.

For minors, generally speaking, the statue of limitations is two years or until the child's tenth birthday, whichever is longer.  In the event a child dies due to medical negligence, the statute of limitations is two years only - the date of the child's tenth birthday does not matter in such a case.  Again, pinpointing the statue of limitations is very technical.  You should contact an attorney.  Certain conditions or events may change the length of your statute of limitations, so contact an attorney about your particular case.
