YES, if you have certain types of insurance. If you have health insurance that is not Medicare, Medicaid, Workers’ Compensation, an ERISA plan, or other certain federal or state plans, let your health insurance pay for everything it is obligated to pay. After that, if the at-fault driver’s insurance company pays for your medical bills as part of a settlement or verdict, your medical bills have been paid TWICE – once to the health-care provider and once in your settlement or verdict. If you have health insurance that is not one of the types mentioned above and you have medical payments (sometimes called medical benefits) on your car insurance policy, the medical bills can be paid THREE times – once to the health care provider, once to you by your car insurance, and once by the at-fault driver’s insurance company.
